Replacement phone upgrade

HiI have a contract that i can up grade if I swap my phone. I am happy to do this.The phone however is a replacement due to loss of original one. Can I still upgrade or is it void due to phone not being the original.

I am currently on a 2 year contract with EE. One of my Add Ons is a Roam Further Pass which says "Use your UK Data, unlimited minutes and unlimited texts while abroad in rest of world"I am struggling to find on the EE website what this actually means...
