Upgrading to an Android device on EE

Hi
If I upgrade (my existing EE connection) through EE (shop or over the phone) to an Android device, would the device:
1) Be unlocked?
2) Have an EE variant version of Android installed on the phone or be fully generic?

- No, not when bought from EE.
- It'll have EE branded firmware.
