Samsung s20 ultra order

I upgraded my phone on the 5th march in a we store for a pre order Samsung s20 ultra and have heard nothing at all since. My current phone battery is failing rapidly.

 

i know there is a pandemic going on but what’s annoying me is why haven’t I heard anything at all about my order

Yes, I partially agree that he is talking about stock on the Samsung website, BUT we are being told our order will be fulfilled once stock is received from Samsung, so you might assume that once Samsung receive stock, then there would be enough stock to cover all bases? Just a thought.😉

Lol good luck @MissRoseGold at getting someone to take responsibility for this mess... Because as long as there is two parties involved (EE + Samsung),

Each will just keep blaming each other and saying it's nothing to do with them, it's the others responsibility 😒

 

I miss the good old days, where you got what you paid for...

Back when build quality far outlasted anything comparable, that's produced today... Back when they didn't sell stuff, till the actually had the product and stock to sell... And back when a company took responsibility for there side of a mess 😅

@Staffie85 tell me about it! This afternoon I was made aware we are in the midst of a global pandemic! 😂 I was wondering why we have to stay home and stay safe 👀

 

I will give it till the end of the May maximum and then re evaluate 🕵🏻‍♀️

As far as we (we being EE customers), Samsung has no obligation to us whatsoever.  We don't have any direct contract with Samsung. 

 

Samsung are the supplier to EE and our contracts are directly with EE.  It is up to EE to honour those contracts and/or (at the very least) give us a reasonable explanation of why they can't fulfill these contracts.

 

We are all adults here and I would guess that most of us can take bad news as long as it is honest and keeps us informed.  This allows us us to make an informed decision on how we wish to proceed.

 

EE do not seem capable of providing us with honest answers.   How difficult would it be for them to say "Sorry but there is an issue with stock and at present we can't confirm a fixed delivery date.  Would you like to cancel your order or wait on stock?"

 

EE seem more intent on lying to customers and evading relevant questions.  Even on this forum, they seem intent on hitting us with stock cut and paste replies.

 

It is evident that EE are more interested in taking our money upfront and have no interest in actually helping customers. The fact that they are still taking new orders for these phones is disgusting - while so many have been waiting since February and March.

 

The irony is EE shout to the rooftops about helping customers throughout the covid-19 epidemic.  Personally, I have received no help from them whatsoever and this forum clearly shows neither have many others,

 

A little bit of honesty goes a long way.

 

 

You are right - Samsung suplies to EE and our issue is with them.  I wonder though, if we have ordered the 512 from them then doesn't that constitute a 'contract' and their inability to supply the phone is therefore a breach of contract. The fact that they can't get them is irrelevant - that is not our issue.  Is there a lawyer / solicitor on here that would know about these things ?

Surely you jest @MissRoseGold 🤔i thought everyone becoming hermits was just the new fad, that people seen doing... So they copied 😅

If there was such a pandemic about, it would surely be plastered all over the news and internet 🤫🤭

 

But seriously, all I want is an honest answer... Like is there any chance of us receiving the S20 Ultra 512GB model before the May 31st deadline for the free Galaxy buds plus offer?

If there ain't then at least tell us so we can change our orders and get all our upfront money back...

That you (EE) is earning interest on, for all this time you have had it all, without delivering on your side of the contract.

@Bassett  I can offer advice, I have recently finished a qualifying Law Degree and volunteer for a online law clinic.

Far as I can establish it comes under tort law, which would be a civil wrong. Samsung are the supplier to EE, EE supply to the customers. They BOTH have a duty of care to make sure the orders are fulfilled, if not they need to provide a solution which would be deemed reasonable and to benefit the customer.

 

The T&C's on the email I received from my pre order states:

 

Whenever you pre-order (i.e. order a device before it is launched), or order a device that is currently out of stock, we will aim to send it to you within 30 days either of the launch date (pre-orders) or of your order (out of stock devices).

 

In my case, I pre ordered 53 days ago (28th February)

 

Sometimes, due to demand, we will not be able to send it to you within this time. If so, we will let you know and if you are unhappy to wait more than 30 days, you can cancel this order.

 

In my case,  I have not received information of this sort

 

This means we will refund any deposit or amount you have paid for the device and cancel your account.

 

My order is still an open order....

 

If you are an upgrading customer, and you decide to cancel this kind of order, you'll still have to pay for any services used before cancelling.

 

Not if you have not received the handset, the contract starts from when you receive the phone, you should not be charged anything until that point.

 

When you pre-order or order a device that is out of stock, your contract with us starts when your order is accepted but your plan will start at (and you will be charged from) the moment we send your new device out to you (i.e. just before you receive it).

 

My understanding is that if EE have not been able to provide the phone within the 30 days which appears to be the maximum considered wait time BUT we are in the middle of a global pandemic, so therefore it would be considered reasonable to be offered a similar product, in this case the 128GB version in place of the 512GB - They should also not be selling the 512GB if they are NOT certain when or if it shall be re-stocked. In my opinion, you could only promise this based on the actual probability and certainty that it will come into stock. 

 

It is not reasonable that people should wait over 30 days for a handset, nor should they loose out on any promotional offers due to the original orders not being fulfilled due to stock levels. 

 

This is just my understanding of the situation, I accept no liability for any information deemed to be incorrect at time of writing.

You have been more then helpful @MissRoseGold and I'm sure everyone here really appreciates you going out your way to help us all.

 

Specially as LAW in itself is not a simple thing, hence it comprising of loads of individual specialist fields... So any advice you can give us, is greatly appreciated, even if it's just a little.

As for me I ordered over the phone on the 26th of February and have received no information or contact from EE regarding it since the 2 texts I received promising I would receive it on the 10th of March and then the 13th of March.

 

I have chased them up numerous times about my order and was told either "No idea when we are getting stock" and the third week of March was told "Withing 21 days"... End of March "Withing 14 days"... Beginning of April "Within 7 days"...

But as you can see they didn't deliver and I'm still waiting.

 

Now I just get told "No idea when we are getting stock and if you lose out on the free earbuds, that's neither our fault or our problem" EE customer service representative's words, not mine 😒
