If i got my phone repaired through an outsourced insurance, would the phone still be eligible for an upgrade anytime?

Hiya,
Reading the terms and conditions - to answer the above question - if a device is in perfect working order but has been replaced by an outsourced insurance - can it be used for anytime upgrade? The terms and conditions only make reference to EE or manufacturer-approved repairs (which most insurers are).
