An example of the more info being provided in the initial post, the better. Did you purchase your "new contract" via online/telesales or instore in a retail shop?

If the latter, you have no automatic right of return except in specific circumstances which don't seem to (on the basis of your posts so far) apply here. If online or telesales, you have an automatic "change of mind" right of return which you may be best using.

To transfer the ownership of an existing line, you will need to follow the "transfer to a friend, colleague or family member" advice under https://ee.co.uk/help/help-new/managing-and-using-my-account/change-my-account/how-do-i-change-my-ac... to perform a change of legal ownership.

Changing your phone whilst keeping your number, is called an upgrade and when you purchase your chosen new phone as an upgrade, this will happen as a matter of course.

EE don't otherwise transfer numbers between accounts, you will need to follow one of two processes.

1: Port your number out to another network using a PAC, and then reverse port back in using a PAC.

2: Give 30days cancellation notice on your contract, and migrate the number to EE PAYG. Then migrate back to pay-monthly via CS.

the thing is that the old number is on my brother-in-law's contract, how could I put his number in my new contract?
