Faulty contract good as new phone

Hi all ,I got an upgrade to a samsung s22ultra good as new in October, it charged fine for the first few weeks then started to take hours to charge up ,I told ee what I thought was in the 30 days ,but they said it was 34 days after ,they want to fix the phone ,but this issue has totally put me off the phone and I would prefer to swap to a different phone ,regardless of increase in monthly payments, but I've been told that's not allowed ,is there a consumer act I can't use to swap this phone as its like still using my broken Sony xperia 1 was and that in all fairness was a great phone ,I took another contract last week for my husband ,an iPhone 14 plus ,and his phones battery is amazing compared to this one ,any help would be much appreciated
