Locked phone

I am pretty disgusted with EE after discovering today that not only is my new phone locked to the network but that on top of that I have to wait 6 months before  it can be unlocked but only if I pay EE to do this!!! Not happy about this at all especially because it's  now less than 5 months until the outright ban by Ofcom on selling locked phones comes into force in December, meaning that the ban will have already come into effect before I am going to be allowed to get it unlocked and forced by EE to pay to have it done! I have to say that  is some very underhanded tactics from a company with such massive profits!

@XRaySpeX Regardless of whether you think its rubbish by still selling phones now that cannot be unlocked at all for a period of 6 months which will be after the ban comes into force it is going to be directly against Ofcom regulations which will be in effect  before that waiting period is over that EE then still intend to charge to unlock 

@XRaySpeX Thanks you just proved my point you used the term inferring that it can't take effect before the relevant legislation takes effect and I I said it means taking effect after not before!

For anyone who feels they may be caught out by the same situation of a dual-SIM phone sold which is not fit for purpose, I would recommend the purchase should be made at a distance and the retailer should be informed in advance that the dual-SIM phone is to be used with another SIM and that other SIM will be on a different network.

 

I'm also a dual-SIM user, on my second such phone, and invariably the two SIMs are on different networks. As such, I feel that for the general consumer, any dual-SIM phone which is locked to a single network is prima facie not fit for purpose. 🤓

@KyleJB   The new ruling is phones will be sold unlocked there is no ruling on current devices sold.   As I said EE might change their T&Cs in December so you can request the device to be unlocked before the 6 months are up but you’ll have to wait till December to find out.    Your argument is about the current T&Cs and at present these are still correct,  I don’t know why you are arguing about something that’s not relevant yet.   

 You have no idea on what EE are going to do about devices sold locked before December come December so why are you trying to make a point about something that you have no knowledge off.    EE don’t have to declare anything about what they are going to do until December about currently locked devices and yes EE can still hold the 6 month ruling if they choose to because it’s devices sold when the ruling comes in to effect not currently sold devices.

@Chris_B that's now at least 3 times that you have said the same thing which still doesn't make you correct in what you are saying, the words absolute piffle sping to mind as by still selling me a phone that cannot be unlocked at all until after the ban comes into effect and intending to make me pay for it will be in direct contravention of the Ofcom regulations that will have taken effect before the waiting period is over I don't care how many times you repeat yourself it does not & will not make what you are saying correct. There should already be provisions by EE to ensure that customers are treated fairly and not sold handset's that are still going to be network locked & then charged to unlock them as is inted by by EE  in my case that's after the ban has already taken effect 

@Chris_B And it really is utterly absurd that you and others keep trying to insist that being sold a phone now that cannot be unlocked at all for at least 6 months which will be after the ban comes into force means absolutely nothing they are knowingly selling you a phone that will be against Ofcom regulations end of! No if ands or buts about it!!!

Not absurd at all! Ofcom's Regs relate solely to devices sold after Dec. 1st. Yours isn't! So they don't apply to it.

@XRaySpeX I will clamp you right up! As I will pass this information on to Ofcom directly in an official complaint that I WILL  be making first thing Monday morning and update  this post accordingly, then we shall see who's right and what EE intends to do to put it right because as far as I am concerned they still intend to force people in this same situation as myself to pay to have a phone unlocked from their network & totally  ignore the Ofcom ban when it comes into force regardless of what Ofcom or anyone else has to say. 🤬🤬🤬

That's OK. I'm unclampable and have no obligations towards Ofcom. Good luck with it when Ofcom put you on the right track away from your perverse reading of the Regs.
