Moved from BT but package not charged correctly

I moved to EE for broadband a digital phone last year from BT, after signing up for a package that I had negotiated a great deal on. I only recently signed up to view my bills online after noticing a whopper bill payment come out of my account, only to find that I am not (and never have been) on the right package/price. EE are saying that the deal....which I have all the email confirmations of, including price, switch over date etc... would never have existed, and would have been missold to me.

Should I be chasing for a refund? Missold was the term used by the Ee rep. I've been paying about £10 per month too much, so worth pursuing I think. I have offered to forward all the emails to them, but they say there's nothing they can do.
