Can I give my upgrade to my daughter who's number isn't due an upgrade?

@Jennyw86 You can do. But just to inform you you will be breaking the T&Cs of your contract as your not allowed to sell or give the device away for the first 6 months of your contract as your still purchasing the device from EE and EE can blacklist the device if they choose too. But I’ve never known EE to ever do this.
I’ve done this is the past so you have nothing to worry about to be honest. I hope your daughter enjoys the new device.

Yes, you may temporarily loan your phone to your daughter for the 1st 6 months.

@XRaySpeX It doesn’t say anything about temporary loaning the device so perhaps you can.
3.13 You may get Equipment from Us when you take out a Price Plan. Unless We tell you otherwise, We will own any Equipment provided by Us for the first six months of the Minimum Term. During this time, You:
3.13.1 Cannot sell or otherwise permanently give the Equipment to anyone else.
3.13.2 Must take all reasonable care of the Equipment and keep it in reasonable condition (subject to usual wear and tear) as if You owned it;
but while it doesn’t say anything about temporary it does say you can not permanently give it away 3.13.1 . But here’s the catch 3.13.2. How can you take reasonable care when it’s not in you’re possession.
I don’t think temporarily will get you out of 3.13.2.

No it doesn't, it says:

By temporary loaning you retain title to the device.
