Hi.
I’m on an Upgrade Anytime plan and I upgraded to the iPhone 13 Pro Max last week which is currently “expect dispatch in more than 28 days”. Anyhoo, I received a text from EE stating if I don’t return my current iPhone within 14 days I’ll be billed for it on my next bill. Surely this is incorrect? I currently don’t expect to receive the new iPhone before Christmas and surely shouldn’t have to return this phone before new one arrives?

I would recommend speaking with our customer care team who can make note on your account that you are experiencing a delay with your new phone.
