Hands down the worst phone I have used, it heats up to ridiculous heats when using for simple things.
The phone itself freezes, won't let me leave apps and when I am on a phone call with someone I either cannot hear them or it cuts off.
I did phone EE and they won't help me, they said I cannot cancel my contract, get a replacement or upgrade. I'm fuming. What am I supposed to do with a faulty phone that isn't even a year old!?
Has anyone else had these issues?
Bearing in mind, this is the phone that EE suggested me whilst I was on the phone!
Useless customer service. Been with EE 15 or so years, and loyalty means nothing anymore.

Has this always been the case, since you had it, or is it something that has happened recently?
If it has been like this from day one or almost, then why wait so long?
You should be able to get it sorted within the warranty time, if under a year, have you tried contacting the company who make the phone?

You don't say how long you've had the phone for? Any distance sales in the UK - which means online or telesales - are covered by a statutory 14days "change of mind" right of return. Not so with face-to-face purchases from a retail store.
Beyond that, and your numerous statutory rights provide for goods that are fit-for-purpose, reasonable quality and so on. Your contract for sale is with the retailer, but in the case of mobile phones, this can often mean following a local repair route - especially if significant time has passed since purchase.
I don't imagine any single network operator in the UK would deviate massively from this.
