Keeping Apple TV box

Hi, 

When i moved to EE I was given an apple TV box. I am near the end of my contarct and thinking about moving. I understand that my Apple TV box was given to me on loan so I have to return it. I do like the Apple TV box so looked at buying one seperatly (Currently £149). However, I read the T&C of EE and it says if I don't return the  Apple TV box I will be charged £120. Surley it is worth me keeping the Apple TV box I already have. 

Is there any reason not too?

The £120 fee is a penalty, not a purchase price. 

The Apple TV would still remain the property of EE.

Ok. But what happens if I pay the penalty but don't return the box?

The TV channels will stop working, obviously.

I'm not sure what is done with Apple TVs - the serial number remains connected to EE on the Apple database but I don't know the implications.
