EE £300 GIFT CARD

Right here we go. I'm having a bit of a nightmare with EE at the moment. I phoned up to upgrade my phone to the pixel 7 pro at the end of October. While on the phone I was sold a different deal to the 1 advertised online, but was told I was still eligible for the £300 gift card. I got my phone on the 3rd November and called EE about my gift card as still hadn't heard anything and was advised upto 21 days after receiving the handset. 21 days went by and still nothing. Contacted EE and was told that it was being raised I can expect a call back within 48 hours. A week went by still nothing. I called again and was advised that I wasn't eligible for the gift card even though I'm paying £60 a month for a new pixel 7 pro. Advised that I will have to open up a complaint and that someone will be in touch regarding the complaint. So someone calls today and says that they are going to accept the gift card but have to do it manually. God knows how long this will take. My question is, am I able to stop this contract and send my phone back on the basis of I was misled into buying this contract? The advisor from the executive department says that I can't do this but I am very seriously considering my options here as I'm being run a bit ragged and totally fed up with the situation. I am thinking of contacting citizens advice and the TSS(trading standards Scotland) for their opinions also. Thanks in advance

No, you have passed your statutory 14-day cooling off period. However you would seem to have a good case to take legal action on the basis of breach of contract & misleading selling.

Hi @Flembo90 and @JohnDarlo71

I recommend speaking directly with our customer service team to discuss the eligibility and look for a resolution.

EE are currently reviewing the conversation I had with the salesperson as if it was mentioned, then they'll honour the reward(I know it was discussed during the upgrade)

I've been promised feedback by the weekend
