Phone Upgrade

Hi all. My phone is due an upgrade and has 23 days left of the contract. I have some question regarding my upgrade and I know one is probably very obvious but I’m in dire need of an upgrade as my phone is starting to freeze up a lot more despite being up to date with the software updates. 
1) Can I upgrade early without paying an early upgrade fee?

2)Can I upgrade without my contract holder as we now live in different cities and transferring the contract is not an option for us as I don’t make enough to cover the bill?

  1. Yes, one may upgrade from 30 days before end of min. term, but see 2.
  2. No, only the A/c Holder may perform contractual actions such as updating & cancelling.
