I have opened and used my upgrade phone. It is less that 14 days since the upgrade and it was bought over the phone. Can I refund this and cancel the contract?

If it is less than 14 days then yes you can. You need to call EE to cancel the upgrade who will then send you a return package,
Once they receive the device and have processed it you will be reverted back to your original contract where you are then able to upgrade again or cancel the contract.
