Apple Watch Ultra 3 Mis sold

Steve03

I recently received from EE, and to express my disappointment with the way the call was conducted, particularly given that I have been a loyal EE customer for almost 17 years.

The call was initially presented in a manner that suggested it related to customer loyalty benefits, discounts, or rewards available to me as a long-standing customer. It was only some way into the conversation that it became apparent that the purpose of the call was to sell me an additional product.

While I was already considering purchasing the product that was being offered, I do not believe the approach used was appropriate. If a call is intended to sell a product or service, this should be made clear from the outset rather than being framed as a discussion about loyalty rewards or customer benefits.

I am also concerned about information provided by the sales agent regarding Apple Watch data. During the call, the agent stated that he would include 4GB of Apple Watch data free of charge and explained that this would normally cost £7 per GB per month. This created the clear impression that I was receiving a benefit worth £28 per month and that I would incur additional costs if I did not accept the offer at that time.

However, the agent had access to my account and usage records and should therefore have been aware that I am subscribed to the EE Essentials Plus plan, which already includes unlimited Apple Watch data at no additional cost. As a result, the representation that 4GB of data was being provided free of charge was misleading, as it was neither a genuine additional benefit nor something I would have needed to pay for under my existing plan.

EE's own published guidance confirms that customers on an Unlimited Essentials Plus plan are entitled to unlimited Apple Watch data at no additional cost. The EE Help page titled "Add Mobile Data to Your Smartwatch" specifically states that customers on an Unlimited Essentials Plus plan are eligible for a free EE data plan for their smartwatch, and that the standard paired watch SIM charge is discounted by 100%, resulting in no additional cost to the customer.

Had I been provided with accurate and transparent information during the call, I would have been in a position to make a fully informed decision. Based on my understanding since reviewing the matter, I could have purchased the same Apple Watch Ultra 3 "Good as New" device for £22.68 per month rather than the £36 per month agreement that I have now entered into. This would have saved me £315 over the term of the contract.

As a customer who has remained with EE for nearly 17 years, I find this experience extremely disappointing. I feel that I was misled regarding both the nature of the call and the value of the benefits being presented to me. This falls well short of the standard of transparency and customer service I have come to expect from EE.

If I was to therefore return the watch and purchase the same watch Sim Free, am I correct in thinking I wouldn't need anything additional and it would work with my Essentials Plus plan?

Hi,

Thanks for the reply.

My plan contract term is 25th May 2025 to 25th May 2027 and it is called EE Essentials Plus Unlimited.

If I am understanding correctly according to the link I posted above, I have an eligible Essentials Plus Unlimited plan and as I opened it after 29th August 2024 watch data would be included free of charge.

@Steve03  You’ll get unlimited data because of the current phone tariff but you’ll still pay the full cost of purchasing the watch and tariff as that’s the package.  You’ll not be charged the watch tariff if you already outright own the watch which you don’t if you are purchasing it on a contract.
EE don’t just sell just the watch on its own it has a tariff associated with it. So you pay for that as well.

To contact EE Customer Services dial 150 From your EE mobile or 0800 956 6000 from any other phone.

@Chris_B  - I can buy the watch from EE Sim Free for just over £22 month for 24 months.

Then reading on the EE help pages about how to get data on the watch with the Essentials Plus tariff is says I have to go into the watch app and mobile services, purchase the £9 month tattoo and a 100% discount is then applied with 24 to 48 hours.

Adding Free Unlimited Data to Your Smart Watch

and this also seems to have been confirmed as the case on this community post unless I am misunderstanding something

@Steve03  Got you it’s not the watch with a contract.  It’s a finance purchase.  You are correct.   If it was a phone sale you have a 14 day cooling off period to reject the Watch.  Sounds like you were sold a full watch contract and not just a watch.  You do the Watch finance purchase online customer Support will always sell it with an airtime contract.

@Chris_B - thank you. This is my main point and why it is mis-selling which would be illegal.

They are selling a product to me which is packaged with unusable benefits and duplications where a benefit is added that I already have elsewhere, in this case making the data a perk.

This is very similar to the package bank account scandal from a number of years ago.

The watch you have has been sold as a paired watch plan which is different from a sim free one. It would have to be proved as mis-selling it's not just automatically mis-sold because you have an ess plus plan which you seem to be claiming. None of us were part of the call so it would have to be listened to & checked what was said etc

Also you're comparing a "good as new" watch with a brand new watch on a contract as well so different watches too

@Steve03   Your phone tariff and what it gives you doesn’t come in to it. You purchased a watch and was sold an airtime contract with it.  What you are looking at online wasn’t what sold to you.     Return in the cooling off period and then make the purchase online via that webpage you’ve shown on here.
