Terms of Service
These Terms of Service set out the terms for use of the EE Community Forum (the Forum), which apply to all users.
By registering to the Forum you are deemed to accept, and agree to abide by, these Terms.
The Terms of Service supplement our terms of website and our privacy policy.
The Forum is not an IT support service. If you need support of this nature, please visit ee.co.uk/help/contact-us.
The Forum is owned and operated by EE Limited (written as "we" or "EE" in these Terms of Service). We are registered in England and Wales under company number 02382161 and have our registered office at Trident Place, Mosquito Way, Hatfield, Hertfordshire AL10 9BW, UK. Our VAT number is 771 5920 16. We are a limited company and are regulated by the Office of Communications (Ofcom).
Use of your information:
EE is the data controller for the purpose of the Data Protection Act 1998. By using the Forum you agree that we may process the personal data (including any sensitive personal data) that we collect from you when you use the Forum in accordance with our privacy policy. In particular, we may use information that you provide on the Forum and the way that you access the Forum to assess how the Forum is used and to improve it. We may also share aggregated data relating to use of the Forum with third parties but such data will not identify individual users of the Forum. Please read our privacy policy for more information about the way that we process personal data.
Registration:
To post content to the Forum you'll need to complete our community registration form.
Your username will appear as part of your content when published. You must make sure your username complies with the Rules.
Adding Content to the Forum:
You must make sure your content complies with the Rules (below), and with our Community Guidelines.
Moderation:
We may review the content you submit to the Forum to check it complies with our Rules (below) and our Community Guidelines.
If it does not comply, or for any other reason, we can reject your content and it will not appear on the Forum. We can't guarantee that all content will be published. We may also at any time and without notice remove and destroy content that has been published.
We will determine, in our absolute discretion, whether any content breaches the Rules. We reserve the right to remove, or to disable access to, any content which we deem to be potentially defamatory of any person or which we deem unlawful. We may also remove content from the Forum that contains outdated or inaccurate information as well as content that has had no activity for a period greater than 6 months. We will preserve any older content where we feel the information is relevant to current or future products or services and where it is of benefit to you. We may also remove without notice 'duplicate' content made by members. Where we do, we will endeavour to leave in-tact the post within the most relevant area of the Forum.
If you post any content that is not in line with the Rules and our Community Guidelines, we may permanently terminate your access to the Forum. You must not evade bans or otherwise disregard directions from moderators.
We are under no obligation to you or any other person to oversee, monitor or moderate the Forum or any other service we provide on our site and we may stop moderating the Forum at any time. We expressly exclude our liability for any loss or damage arising from the use of the Forum by any person in contravention of the Rules or Community Guidelines, whether the Forum is moderated or not. We also remind you that all content represents the opinions of the user who posted it, not EE, and we are not liable for the content of your comments.
Rules:
These Rules apply to all content. They must be complied with in spirit as well as to the letter.
You also must ensure that your involvement in the EE Community adheres to the EE Community Guidelines.
If only part of an individual piece of content breaches these Rules or the Guidelines then we can remove the whole piece of content from the Forum. No failure to remove particular material constitutes an endorsement or acceptance of it by us.
You should make sure your content:
-- Is unlikely to deceive anybody and are accurate where they state facts.
-- Complies with all applicable laws in the UK (including defamation) and in any country from which the content is posted.
-- Isn't defamatory or likely to harass, threaten, abuse, upset, embarrass, alarm, inconvenience or annoy anyone, or cause needless anxiety.
-- Isn't obscene, offensive, hateful or inflammatory or discriminatory on the basis of race, religion, nationality, disability, gender choice, sexual orientation or age.
-- Doesn't promote sexually explicit material or encourage or facilitate violence.
-- Doesn't disclose anyone's personal contact details or invade their privacy.
-- Doesn't impersonate any person, or misrepresent your identity or affiliation with any person.
-- Doesn't infringe any copyright, trade mark, database right or other intellectual property right.
-- Doesn't imply you are associated with EE.
-- Doesn't in any way promote or incite anyone to commit or assist in any unlawful or criminal activity or anti-social behaviour, or encourage activities which could endanger the safety or well-being of others.
-- Doesn't advertise or promote other services. You may include web links, but only where relevant to the discussion.
-- Isn't made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
-- Isn't used to gain sponsorship, or to petition, campaign, scheme or send chain messages.
The above list is not exhaustive.
If you want to complain about any content posted to the Forum, please use the "Report inappropriate content" feature or contact a Community Manager. We'll then decide whether the content complies with our Rules.
Use of the Forum by Minors:
You must be at least 16 years old to use the Forum or have permission from your parent/guardian.
We advise parents who permit their children to use the Forum that it is important that they communicate with their children about their safety online. Please see our child safety website, explore.ee.co.uk/digital-living, for more information.
Copyright:
For the avoidance of doubt, unless otherwise indicated on the Forum, nothing in this section is intended to give us the right to commercially exploit anything you submit to our Forum. These licenses are simply to allow us to display your comments on the Forum or our website. From time to time however we may run events on the Forum asking you to submit ideas specifically for us to commercially exploit: we will always make this clear to you.
By submitting content to the Forum, you grant us a non-exclusive licence to use that content. Although you'll still own the copyright in your content, we'll have the right to freely use, reproduce, publish and/or distribute, edit and/or alter for moderation purposes, your content. This licence will be free of charge, perpetual and capable of sub-licence. We may exercise all copyright and publicity rights in your comment in all jurisdictions, to their full extent and for the full period for which any such rights exist in that material.
If you're not in a position to grant such a licence to us, please don't submit the comment to the Forum.
Breach of these Rules:
If we, in our sole discretion, think there's been a breach of the Rules and/or our Community Guidelines, or we have reasonable grounds to believe that you are likely to breach the Rules and Community Guidelines, and therefore the terms of use upon which you are permitted to use our site, we may take any action we think is necessary.
If you don't comply with these Rules we may:
-- Immediately withdraw your right to use the Forum.
-- Immediately remove any content already posted by you or any material uploaded by you on the Forum.
-- Issue you a warning that we will withdraw your content, remove any material uploaded by you, or withdraw your right to use the Forum.
-- Take legal proceedings against you. For example, if we have to pay damages because of what you've written, we'll be able to sue you to get that amount back.
-- Disclose any information to law enforcement authorities we think is necessary or as required by law. For example, if something you've posted is in breach of child protection laws.
We exclude our liability for all action we may take in response to breaches of these Rules. The actions described above are not limited, and we may take any other action we reasonably deem appropriate.
Changes to the Rules:
We may revise these Rules at any time. You are expected to check these Terms of Service terms from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in these Rules may also be superseded by provisions or notices published elsewhere on our site.
