my phone was stolen.. I aim to claim but can upgrade incase claim takes too long

I have absolutely no phone at all. Can I upgrade early (upgrade date is august) and claim and when claim comes through send back sim as I will already have one. I dont want to not claim as this is what I pay insurance.
very annoyingly my phone was stolen conveniently outside of EE phone assistant opening hours. Just wanted some advice. theres absolutely no information or queeries on a situation like mine which I find extremely frustrating too.
