Hi my phone is in my exs name. Our contracts ran out Dec roughly. .. can I keep my same number and phone and get another sim in my name

You can get your own SIM but the no. belongs to your ex. So unless you can persuade her to do a change of ownership to you, you can't take it with you.

To add, if "your" phone is in your ex's name, then legally - it's not "your" phone, it's your ex's.

It is upto your ex what happens to it until & unless they agree to perform a legal change of ownership and it is transferred into your name.
