Current terms on selling your phone mid-contract with FlexPay

I remember previously you only own the device after 6 months to be able to sell the phone, but looking at the documents that are on my account I'm not seeing the 6 months mentioned at all.

Have the terms changed since they introduced Flex Pay monthly contracts, or are the terms in another document that I'm not seeing.

My phone is 1 year old, and have bought a new one outright, so want to check if I can sell this one during contract (24M)

As far as I'm aware now you've got a fixed-sum loan/credit agreement you make the repayments towards, which essentially was used to purchase the phone from EE at the beginning of the contract.

As long as you continue to pay off the device payments, you should be OK to do what you like with the device.

Happy to be corrected here by someone else however.

@Matt_124 : Sounds right! I guess, like a car, it can be repossessed if the load is not paid off in time.

That's my hope, but I remember it being specifically mentioned that EE own the device for "six months" but I can't see it on the terms now at all.

That's when your monthly payments are going directly towards buying a phone & plan. Here you are paying off a credit loan (or 'load' as I called it earlier 😉).

So I should be fine trading it in / selling it whilst I still pay it off then?

Don't want it rejected if I end up sending it to a third party site like Envirofone, etc 😅

Hey there @GHamilton, welcome back to the Community!

I've had a look over the most recent network terms for device credit agreements, and under the equipment section nothing specific is mentioned around ownership or selling on within the contract term.

You can see in section 12 that in certain circumstances we may blocklist the equipment though, and two of these situations fall closer to your query.

The two instances it mentions are 12.3.1, not making any successful payments within the first six months of the agreement, or 12.3.3, no UK usage of the equipment being detected since the start of the contract.

Provided you keep all payments going, and the phone has been used on our network prior to sale, the terms don't highlight any other issues I can see here 😊
