Yes I thought so aswell but there saying I can’t because I took the phone out on finance with EE for 36month ?

That isn’t true. Distance selling rules mean you have a limited amount of time usually 14 days, a cooling off period, to change your mind. Just because you are forced to take out your handset over 24 or 36 months is irrelevant.

@Tronny Was it a store sale ? You don’t know and that doesn’t have a 14 day cooling of period

if the device is faulty you have 12 days to report that fault and a replacement will be issued. if it was a store sale, just go back to the store and report the fault.
